These terms govern every order placed with KloudDrop Pty Ltd through this website.

1. About us and these terms

KloudDrop Pty Ltd operates a mobile shisha delivery and equipment-hire service in selected Inner West Sydney suburbs. By placing an order you agree to these terms, our Equipment Hire Terms, Refund Policy, Privacy Policy and Responsible Service page. These terms are governed by the laws of New South Wales, Australia.

2. Strictly 18+ — identification is checked at delivery

You must be at least 18 years of age to order. Our worker will ask to sight approved photo identification (an Australian driver licence or photo card, an Australian or foreign passport, or a NSW Proof of Age card) before any equipment or product is handed over. If identification is not produced, is expired, appears altered, or we are not reasonably satisfied that the person receiving the order is 18 or over, we will refuse the delivery. Under NSW law it is an offence to supply tobacco or non-tobacco smoking products to a person under 18, and it is an offence for an adult to purchase them on a minor's behalf. Where we suspect a proxy purchase for a minor, we will refuse service and no refund of any delivery or call-out fee is payable.

3. Guest ordering — no customer accounts

KloudDrop checkout is guest-based. We do not create customer logins or password-protected accounts on this website. Your order is confirmed when you receive a KloudDrop order number, and you can follow the order using the private tracking link issued to you. Keep that link private — anyone with it can see your delivery details.

4. Ordering, availability and pricing

Orders are subject to delivery-zone coverage, van capacity, staff availability and stock at the time you order. Prices shown on this site are in Australian dollars and include GST where applicable; the price charged is the price displayed at checkout. Some packages are only available on particular days of the week, and any such restriction is shown on the package. We may decline or cancel an order before dispatch — if we do, you are refunded in full.

5. Payment

You may pay online through our payment provider or with cash on delivery where that option is offered. Card details are handled by the payment provider, not by KloudDrop. A refundable equipment deposit may apply to hire items; where a deposit applies, the amount is shown to you before you confirm the order. We do not charge amounts that were not disclosed at checkout.

6. Delivery, access and collection

Delivery times shown are estimates, not guarantees. You must give an accurate address and access instructions, and an adult must be present to receive the delivery and present identification. If we cannot access the address, no one is present, or the recipient cannot be verified as 18 or over, the order is treated as a failed delivery and a call-out fee may apply. Hire equipment must be available for collection at the agreed collection window.

7. Smoke-free laws, venue permission and safe use

Shisha may only be used where it is lawful to do so. Smoke-free laws in New South Wales apply to tobacco and to non-tobacco smoking products such as herbal shisha, and they restrict smoking in enclosed public places, in and around many outdoor public areas, in commercial outdoor dining areas, and in vehicles carrying a person under 16. You are responsible for confirming that smoking is permitted at the delivery location, for obtaining the property owner's, strata's, landlord's or venue's permission, and for keeping smoke away from other people. Event organisers carry the same responsibility for their venue and their guests.

8. Your rights under the Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies those guarantees or any other right you have under law. Our cancellation, refund and deposit rules operate in addition to, not instead of, those non-excludable rights. See our Refund Policy for how we handle cancellations, faults and missing items.

9. Liability

To the extent permitted by law, and subject to the Australian Consumer Law, we are not liable for indirect or consequential loss arising from your use of our products or services, and our liability for a failure to comply with a consumer guarantee is limited to resupplying the service or paying the cost of resupply, where it is fair and reasonable to do so. Nothing here limits liability that cannot be limited by law.

10. Changes to these terms

We may update these terms. The version and effective date at the top of this page identify the current document. The terms that apply to your order are those published when you placed it.

11. Contact and complaints

Questions, complaints or disputes about an order can be sent to contact@klouddrop.com or through our Contact page. We aim to acknowledge complaints within two business days. If we cannot resolve a matter with you, you may contact NSW Fair Trading or the ACCC.

These pages summarise how KloudDrop operates. They do not replace, limit or override the law, including the Public Health (Tobacco) Act 2008 (NSW), the Australian Consumer Law and the Privacy Act 1988 (Cth). Where this website differs from legislation, the legislation applies.
